In an astonishing circumstance, investigators today uncovered the missing service records and personnel files of GOLD HILL POLICE CHIEF DEAN MUCHOW.
 
Although the details of what brought the investigative team to be digging under a steel staircase attached to a home in Union, Oregon belonging to Muchow, are still unknown, it does solve a riddle that has been plaguing Muchow for some time.
 
"That is really wild" Muchow said, "I wondered where those were."
 
The steamy pile was taken to local forensics laboratories for more in depth investigation. One investigator who asked not to be identified said "At a glance, I think it was pretty obvious why he doesn't offer this to prospective employers."

While other Rogue Valley agencies were sending personnel to help find the lost 8 year old in Crater Lake, Gold Hill Police Chief Dean Muchow was commandeering officers from OSP, Central Point, JCSO and Rogue River to sieze this computer because this computer is where the record of his unfitness to wear an officer's uniform is laid out for all the public to see. And as has been the case in the past, Gold Hill, the sick man of the Rogue Valley, is able to reach out and touch the neighboring cities via it's derelict police departments, in this case by using the taxes of the residents of Central Point and Rogue River and the scarce resources of JCSO to try and save his pathetic career.

A nice thing about Oregon Law is that is written so that a layman with a decent command of the English Language can understand it.
 
165.800 Identity theft. (1) A person commits the crime of identity theft if the person, with the intent to deceive or to defraud, obtains, possesses, transfers, creates, utters or converts to the person’s own use the personal identification of another person.

      (2) Identity theft is a Class C felony.

      (3) It is an affirmative defense to violating subsection (1) of this section that the person charged with the offense:

      (a) Was under 21 years of age at the time of committing the offense and the person used the personal identification of another person solely for the purpose of purchasing alcohol;

      (b) Was under 18 years of age at the time of committing the offense and the person used the personal identification of another person solely for the purpose of purchasing tobacco products; or

      (c) Used the personal identification of another person solely for the purpose of misrepresenting the person’s age to gain access to a:

      (A) Place the access to which is restricted based on age; or

      (B) Benefit based on age.

      (4) As used in this section:

      (a) “Another person” means a real or imaginary person.

      (b) “Personal identification” includes, but is not limited to, any written document or electronic data that does, or purports to, provide information concerning:

      (A) A person’s name, address or telephone number;

      (B) A person’s driving privileges;

      (C) A person’s Social Security number or tax identification number;

      (D) A person’s citizenship status or alien identification number;

      (E) A person’s employment status, employer or place of employment;

      (F) The identification number assigned to a person by a person’s employer;

      (G) The maiden name of a person or a person’s mother;

      (H) The identifying number of a person’s depository account at a financial institution, as defined in ORS 706.008, or a credit card account;

      (I) A person’s signature or a copy of a person’s signature;

      (J) A person’s electronic mail name, electronic mail signature, electronic mail address or electronic mail account;

      (K) A person’s photograph;

      (L) A person’s date of birth; and

      (M) A person’s personal identification number. [1999 c.1022 §1; 2001 c.870 §3]

Now Dean Muchow knew he didn't have identity theft when he went to Judge Purdy, any more than he thought there was a threat of violence at my house when he rounded up 4 other legitimate agencies to storm our residence. He called US Observer Ed Snook to "report" the big raid in his paper that nobody reads. It is a staged event...Muchow's "October surprise" for the Gold Hill voters.

 

A LIAR AND THIEF IN A UNIFORM IS A DISGRACE

ADVISED NOT TO HIRE HIM
Dean Muchow was hired by the City Council of Gold Hill after they were strongly advised by City County Insurance company not to hire him. It was not long before his performance, particularly his penchant for lying, began to make certain councilors regret their choice and a certain citizen, namely myself, start looking for answers of where this person came from and what the reasons were that the City was warned away from him. To this end I set out to research from the newspapers in Union, Oregon where he had come from and from there I was able to follow his career into Idaho. I think that it is notable that when Muchow applied for a job in Gold Hill, he did not present his service records from either Idaho or California where he had previously been employed in law enforcement, neither did he present his personnel file from Union, Oregon. So in a large part, and it is not unusual that the dereliction that resulted in his coming into the employ of Gold Hill, started with the City Council.

It was easy enough to track his record in the La Grande Observer, and another online publication, Union Republic, or http://unionrepublic.com/archive/. We reprinted the articles and  information that we found there.
The upshot  was that in Union, two other law enforcement officials, namely the District Attorney Martin Birnbaum and Juvenile  director Jim Brougham  took the unusual step of going to the hiring agency, which was the City of Union, and reporting improprieties in the conduct of Union Police Chief Dean Muchow to the City Administrator. The City Administrator then put Chief Muchow on administrative leave to have the City Council consider the allegations. Muchow reportedly made a big bluff and bluster that he would "waive his right to be heard in executive session" and get everything out in the public,  but when the day came, he went out with a whimper and hand in hand with his attorney went  negotiated in secret with the Union City Councilors that in exchange for keeping the material in complaints silent, he would resign.

In an AP article dated October 15, 2004 it states " One case involved a juvenile who was said to have reported that his stepfather was abusing his mother. The child then reported the abuse to his teacher. It was alleged that Muchow went to the home to interview the stepfather in front of the boy. Moreover that he revealed the identity of the teacher to whom the boy had confided". 
 
An ex councilor in   Union also reported that Muchow had revealed the location of the "safe house" to  disgraced Union Mayor Dave Thomas, whose  family had sought protective shelter.
 
The AP article goes on to state.
 
" In another case, complaints were made that Muchow improperly obtained evidence from an alleged female juvenile sex abuse victim."
 
To escape having to answer these complaints, Muchow resigned, which is where my complaint starts. I am under the impression that Oregon's Department of Public Safety Standards and Training, DPSST. that certifies officers, is commissioned to  keep  records of the cirucumstances under which officers leave the employment of a hiring agency and to investigate the conduct of it's officers when the evidence warrants it.  While it may be well and good for the Union City Council to rid themselves of this guy, a small city like Gold Hill depends upon the credential of any officer that applys to work and has the right to believe that the certification from DPSST means something. There was no referral to the DPSST from Union, and as Muchow resigned, it does not appear that DPSST was aware of the conduct that was in question.

The Gold Hill City Council never saw the contents of that file and it has now disappeared out of Union City Hall, according to a conversation I had with the current Union City Recorder. The file was no longer in the building after Muchow supporter Mayor Deb Clark, (recalled in the spring of 2006) left office.
 
Guilty of harassment in Idaho
 
But Muchow's sordid history did not stop or start in Union. Prior to his employment in Union, he worked for Valley County Sheriffs in Idaho where he was the respondent in a harassment case where Valley County was forced to pay the victim some undisclosed amount of money for the damage that Muchow inflicted upon her. The record of this case is archived in the 9th District Court, Elam vs Muchow.Terry Elam vs Dean Muchow 9th Circuit Court.   COURT CASE CIV-96-0508-S-MHW
 
Concealed evidence in McCall, Idaho
 
Muchow was also employed in McCall Idaho where he distinguished himself in that the prosecuting  attorney  for that city refuse to prosecute any cases where Dean Muchow was the only officer testifying. Attorney Jamie Shropshire stated that she wrote a letter to his commanding officer so stating after she had certain knowledge that Dean Muchow had deliberately concealed the fact that he was in possession of a weapon that was being sought in a criminal case.

What is DPSST responsibilty to citizens??
 
As for this citizen, I think I have the right to know that the DPSST has full knowlege of  Muchow and his conduct in Valley County, his conduct in McCall, Idaho, the allegations of improper conduct with a minor in Union and other charges, BEFORE he approaches my 15 year old daughter with all the authority that a badge gives him.  
 
 
HOBART
 
Hank Hobart, is exactly what he appears to be, a little guttersnipe in a police uniform.
 
 Hank Hobart's  dirty past is rather short and sweet. Hobart was fired in Oakland, Oregon for MORAL TURPITUDE. Remember, Hobart would have been a Union employee and the Union can damn near get you out of hell,  but they weren't able to save old Hank's bacon. He was caught sleeping with a Douglas County Sheriff's wife, while the officer was on duty.
Today Hobart got more reward than he imagined from crossing swords with me, getting to violate my home the same way he got a kick out of violating another man's marriage bed by screwing his wife.
 
 
My point, if I have to spell it out, is that these two men have already exhibited conduct that demonstrates that they have lower moral standards than that of the general public. Furthermore, I contend that they  can not, with any credibility represent law enforcement in this society. In short, they make a mockery out of law enforcement.  
 
To this end, this site has kept a sporadic record of Muchow's continued improprieties regarding his mishandling of public resources and money and his collusion to defraud the City of Gold Hill by signing timecards for Hobart for hours that Hobart did not work.
 
Muchow's latest move, well before obtaining a warrant to seize this computer, was to attempt with the aid of Council woman and Muchow sycophant, Kathleen Price, to frame,  with false statements to OSP Jeff Proulx, charges that Councilor Gus Wolf had received "free dirt" from a contractor working by Wolf's home. Wolf's offense? he attempted to get records of Muchows spending.  
 
And as in the past, one by one, the legitimate law enforcement agencies, start to smell something rotten in police uniforms in Gold  Hill.
 
I like to reference with pride that everything I know about bad officers, I have learned from good officers. I have often been accused of  disliking police officers in general. That is not the case. It can be noted, and without checking I do not believe you can find any place on this website where I have used the term PIG, in reference to police, even the Gold Hill cops. I don't use it. I do worse, I use the names of those persons. I know that we have to have law enforcement, but bad law enforcement is that antithesis of good law enforcement. Professional law enforcement tries to stay constantly diligent to keep out those who are unfit. Unprofessional agencies like Gold Hill, continue to hire the cast offs and never-came-close,  of the professional agencies. If we had anyone that was of professional caliber, a legitimate agency would hire him like Mike Winters hired Rod Countryman. JSCO has just implemented a 40 page interview questionaire to better enable it to keep these ding-dongs out of their ranks. The fact that a breed of sociopath is constantly trying to get into law enforcement agencies is an acknowledged fact that they deal with on a daily basis. So there is no mystery as to how a town like Gold Hill, that can't even abide by the insurance company investigators background checks, and hires people with  big black marks after their names, continue to create a public nuisance by operating these bad departments.
A warning:  when your words threaten   a person like Dean Muchow that he may  have to take his snout out of the public feedbag and work for living, the results are predictable.

EDITORS NOTE: it seemed to me that the following article left out some critical information. It would be a shame if the two liars who contrived to have the complaint lodged with OSP, Councilor Kathleen Price and Police Chief Dean Muchow weren't given credit for their actions. How it was worked was Price, under Muchow's direction, filed the complaint against Wolf and then Muchow himself puts on his uniform and tries to present himself as a disinterested witness. The good thing about it is that now OSP Jeff Proulx knows what Dean Muchow looks like when he lies.

Councilman investigated over a load of fill dirt

GOLD HILL — Oregon State Police are investigating allegations that Councilman Gus Wolf used his city position to obtain favors from a local contractor.

State police have interviewed Royal Gasso, Gold Hill's public works director, and Dean Muchow, the police chief, while trying to determine whether Wolf received free excavation and fill dirt from contractors working on a residential development adjacent to Wolf's home on Seventh Avenue.

Gasso was interviewed by Sgt. Jeff Proulx at OSP headquarters on Thursday afternoon. Gasso said he told Proulx he did not believe Wolf had misused his powers.

"This whole thing is frankly ridiculous," said Gasso. "I can't believe anything that's happened up there warrants an investigation by state police."

Muchow and Proulx declined requests from the Mail Tribune for comment.

Frank McElheran, a superintendent for KOGAP Excavation, said his company rerouted power and phone to Wolf's residence because Wolf's power pole was removed to make way for a new street.

"It cracked me up when I heard that (Wolf was being accused)," said McElheran. "He hasn't caused us any problems. We took the pole out. The power and phone had to be rerouted. We would have done that for anyone."

McElheran said Wolf asked for driveway access to the newly installed Jacoby Street, but Wolf's request was denied without incident.

"As far as strong-arming us, that's never been the case," said McElheran. "That would have been a typical request from any homeowner. He's a very pleasant gentleman as far as we're concerned. Every neighbor up there has been pretty easy-going considering the noise and dust."

Wolf said he was unaware of the investigation. He acknowledged KOGAP dug a line for underground utility service into his yard and dumped a load of fill dirt near his property. Wolf denied that he received any special treatment related to his service on the City Council.

McElheran said many people in the neighborhood have asked for dirt — and received it.

"We've put a lot more than that in other people's yards," said McElheran. "That's a benefit to us. We don't have to haul it away."

Gasso said he'd heard rumblings of the investigation during a recent inspection at the 15-unit project. He said construction workers told him there was nothing inappropriate at Wolf's residence.

"They indicated to me at that time that no undue influence had been brought to bear," said Gasso.

Under scrutiny Police seize former Gold Hill councilwoman's computer

Christine Alford says it's retaliation for complaints against the police department; chief says he's investigating identity theft

GOLD HILL — The author of the "Gold Hill Entrails" Web site lampooning city officials was surprised Monday morning when nearly a dozen police officers searched her home and seized her computer, saying they were investigating claims of identity theft. Alford, a former city councilwoman who was recalled in 2004, was not charged with a crime Monday.

"We've had individuals claiming they are victims. We'll take the evidence where it goes," said Gold Hill Police Chief Dean Muchow, adding he could not provide more details because of the ongoing investigation.

Nine officers from five police agencies joined Muchow in the search, entering Alford's residence in the 200 block of Second Avenue in Gold Hill just after 9 a.m. The officers seized her computer system, including discs, two towers and other related items.

"Our agency requested aid of other agencies for safety reasons," said Muchow, adding Alford was "upset" at the search, but "did not hinder anybody in any way."

Alford said Muchow is trying to silence her because she lodged complaints about the chief with city officials and state regulatory agencies and because she satirizes the chief, his department and other city officials and residents on her Web site.

"I believe in good law enforcement and I believe this city has hired another bad cop," said Alford. "I am going to get my computer back and proceed with (complaints and requests for investigations) ... and continue with my Web site."

Muchow said his investigation of Alford's actions is not retaliatory. He is simply doing his job, he said.

"It's been a lengthy case," said Muchow. "We'll see if things develop or if things fall out.

Alford said Muchow "is absolutely incensed" about her Web site, which not only posts fictitious interviews, but also lists articles, commentary and legal documents that support her contention the police department is corrupt, she said.

"He threatened I wouldn't be able to touch a computer for 10 years," said Alford.

In June, Alford sent an e-mail to City Councilman Gus Wolf and City Recorder Mary Goddard under the guise of former mayor Sherry Young. Alford's e-mail was intended to mock Young — a staunch Muchow supporter — and the authors of another Web site that was soliciting $12,000 for Muchow's legal defense, she said.

"Some people here might want to read this article and consider making a large donation to this fund," Alford's e-mail read. "Maybe they can think of it as a going away present, maybe they can consider it as insurance against being named in Dean's lawsuit."

"The people who read it knew it was a joke because I called and told them it was a joke," said Alford.

Steven Green, a law professor at Willamette University, reviewed Alford's Web site and discussed the ramifications of sending the fictitious e-mail. Alford's Web site is "clearly parody" and therefore protected under the First Amendment, Green said.

"Without a doubt that is protected," he said.

The e-mail may cause problems for Alford because it may fall under identity theft laws, Green said. But the lack of financial benefit to Alford or anyone connected to her would make the matter difficult to prosecute, he said.

"Normally, there would be some type of intent to procure a benefit from someone that you're not entitled to," said Green.

Wolf said the chief is using Alford's e-mail, which he called a "practical joke," to silence a political enemy.

"I see this as retaliatory and vindictive for making accusations or complaints against the police department," said Wolf. "This is scary. It's like a police state. How would you like to have 10 cops tramping through your house?"

Wolf filed complaints against Muchow with the state Department of Public Safety Standards and Training earlier this year.

"I believe there are financial and policy inconsistencies that warrant further investigation," said Wolf.

In August, Muchow appeared before the seven-member Oregon Government Standards and Practices Commission after Alford filed complaints alleging Muchow used his position for personal benefit, receiving free meals from local restaurants and accruing large cell phone bills by making personal calls. Muchow has denied the allegations.

According to commission Interim Director Don Crabtree, Muchow's charges died a "statutory death" after a 3-3 vote because they failed to get the mandatory four affirmative votes.

Muchow insists he is merely following up on citizen complaints and he is not upset about being personally lampooned because he has never read Alford's Web site.

"And I never will," Muchow said.

You can read the statute as well as I, and you have obviously done so.
There is limited case law interpreting the statute.  Since I anticipate
that this office may receive a report from Chief Muchow concerning
emails you may have sent to others using an assumed name, I do not
intend to parse out the statute by ruling on hypothetical situations.

As I told Ms. Specht yesterday.  If the Chief submits a report to this
office, we will review it to determine if the facts alleged constitute a
crime in our opinion.  All criminal cases are tested by applying the
facts of a particular case to the statutes and any relevant case law.
